Separation Agreement
What is a Separation Agreement?
This is for married and unmarried couples who intend to separate and want a legal document drawn up to confirm arrangements for their finances.
What is included in the fixed fee package?
Initial advice by consultation or detailed telephone call in addition to the following:
- Obtaining the information we need to be able to draft the agreement
- Advising you of the implications of signing a Separation Agreement
- Informing you of the financial information needed and drafting a Schedule detailing the same (the Courts have made clear that this sort of agreement is only likely to be followed by them if both parties have exchanged detailed financial information about their circumstances)
- Drafting the agreement
- Arranging for signature by both parties
- Storing the original agreement
Throughout this process we will tell you when one of the above steps has been taken. You will be provided with a direct email address and direct dial telephone number for your solicitor.
How much is the Fixed Fee Separation Agreement Package?
The fixed fee package can be broken down as follows:-
Our fees: £500
VAT on our fees: £100
Total: £600
What is not included in the fixed fee package?
- The fixed fee package assumes a general agreement has been reached between you as regards the basic terms of the agreement. The package is not appropriate in those cases where there are fundamental disagreements between the parties (this work can be conducted at an hourly rate of £150 plus VAT where agreed with you).
- The fixed fee package excludes advice on what agreement you ought to make as that would be based upon a detailed consideration of all of your financial information and would need reports from Independent Financial Advisors and so on. We will however, advise you of the issues you ought to include in your agreement and the implications of signing the same.
Why pay a fixed fee?
By paying a fixed fee at the start of your case you have certainty about the costs involved. The alternative is to pay an hourly rate (currently £150 plus VAT) for the time your solicitor spends on your case. We believe you should pay for the work that needs to be done, rather than the time it takes to do it.
