“Mrs B instructed Linnitts Solicitors after she had found our details on Following her accident at a Shell Garage in Ringwood, near Southampton. Mrs B was on her way to a course in London so stopped off to fill her car with diesel. As Mrs B proceeded through the door she tripped on matting that had been protruding to cause a hazard. As she walked in she tripped, fell over and injured her knee to such a degree that she was taken to the Frome Community Hospital whereby she was diagnosed with a tear to her meniscus of the left knee.

She had initially instructed a firm of solicitors based in Manchester but was not happy with how her personal injury case was progressing. Linnitts engaged in correspondence with the Defendant Insurers who were based in Birmingham. Liability was firmly denied and there was no evidence to support our clients claim other than a witness from Bournemouth who only saw her fall. CCTV missed the accident but you could just about make out a reflection of the accident in one of the freezer doors opposite. The Defendants had refused to disclose this evidence to the previous solicitors so we had to apply for a Pre-Action Disclosure Order in the Poole County Court, in Dorset.

Following service of the Pre-Action Disclosure Order the CCTV was soon disclosed from the Defendant’s head office in Lambeth, London. Negotiation settlements began but the Defendant remained firm on their denial of liability. We instructed Counsel based in Taunton, and prepared the case for the issue of Court proceedings.

Settlement was finally reached to the amount of £7,500 for general damages and £2,500 for special damages. Mrs B enjoyed a holiday in Sharm-el-Sheikh as part of her convalescence.
