Establishing Liability -
Personal Injury Claims

At Linnitts Solicitors we try to establish liability as soon as possible with your opponent, to try and save costs and deal with your personal injury claim as quickly as possible.

It is for you (the Claimant) to prove that:

1. Your opponent (the defendant) owed you a duty of care.
2. That duty was breached.
3. Your opponent caused your injury.

If you can prove all of the above and you are making your personal injury claim within the appropriate time limits (usually 3 years from the date of diagnosis), then you should be entitled to compensation.
